Virginia is in the middle of a significant transition for hemp and cannabis. Here's what's happening, when it happens, and what it means for consumers and businesses in Southwest Virginia.

New oversight begins

The Virginia Cannabis Control Authority (CCA) takes over regulation of hemp-derived products from the Virginia Department of Agriculture and Consumer Services (VDACS). Virginia's new cannabis and hemp laws take effect as part of the state budget.

Hemp product rules change significantly

Virginia eliminates the exemption that previously allowed hemp products with a high CBD-to-THC ratio to contain more than 2mg of THC per package. After August 15, all hemp products sold in Virginia are capped at 2mg of total THC per package — no exceptions. Many hemp products currently on shelves at vape shops, CBD stores, and convenience stores will no longer qualify for legal sale.

Consumer protections take effect

New standards apply to all THC products sold in Virginia: products must be in child-resistant packaging, clearly labeled with THC percentage and milligrams per serving, and accompanied by a certificate of analysis from an accredited independent laboratory. Selling THC products to anyone under 21 becomes a prohibited consumer practice under Virginia law.

Feb 1 2027

Cannabis retail license applications open

The Virginia Cannabis Control Authority begins accepting applications for adult-use retail cannabis licenses. Virginia expects to issue up to 350 retail licenses statewide.

Jul 1 2027

Adult-use retail cannabis sales begin

Licensed retailers across Virginia may begin selling adult-use cannabis to customers 21 and older. Adults may purchase up to 2 ounces per transaction. This opens the first licensed recreational cannabis retail market in Virginia's history.
